Abstract
Accession of Poland to EU structures resulted in need to take a number of adjustment adaptation steps. One of them is the transposition of the European Union regulations into national legislation. This applies to a variety of areas, including railway safety. The problem is relatively new and it requires both the knowledge of the specifics of the railway sector and a number of regulations. The article brought the objective railway market structure closer, paying attention to the role of the government administration authorities and railway boards in shaping of the security postulate. Basic legislation defining the direction of improving safety in rail transport were systematized, and an exemplary model of a safety management system was presented.

Numerous safety definitions operate in the subject literature, which are transferred onto the ground of transport theory. For the needs of the paper in question the definition used in the aviation sector has been used, i.e. safety is the state, in which a possibility of damage to people or property occurrence is minimised and maintains on a permissible level or below this level due to intentionally carried out continuous process of hazards identification and safety risk management.

Since 27 November 2013 the function of minister for transport has been fulfilled by the Ministry of Infrastructure and Development.

There are numerous professional risk assessment methods. In the rail transport the RISC SCORE method is most frequently used, more on that.

In the case of change introduction by a railway manager, the risk assessment is only one of elements of overall change analysis. Because of the need to meet numerous requirements specified in Regulation 352/2009, this issue requires a separate broader discussion.

In the railway sector there is a number of legal requirements in the field of risk monitoring and communicating. These are very extensive issues. This paper presents only basic assumptions in this area.
