Abstract

The authors have presented the key legal, technical and organizational assumptions related to conducting independent evaluations of the adequacy of the risk management process in the rail sector. Key problems related to change management in the railway sector have been defined. On the basis of a number of case studies, a few examples of the implementation of technical, organizational and operational changes have been presented. The authors have suggested their own approach to conducting independent evaluations of risk management processes in rail transport. The proposed approach can be applied successfully in other modes of transport.

    Law on amending the Law on Railway Transport - the choice of the accreditation process as a means of confirming competence of the assessment body (Journal of Laws 2015, item 200).

    Technical risk is a combination of frequency or probability of occurrence of a dangerous event and the consequences of this event. Risk management is a systematic introduction of the management policy, procedures, practices to the tasks of analyzing, determining and controlling risk. The system is an ordered set of any level of complexity, which includes: staff, procedures, materials, tools, equipment, and software. The elements of the ordered set are used in combination in the expected operating environment or supporting the action to perform a task or achieve a particular purpose.     To conduct an independent evaluation, the assessment body:

    (a) ensures the full understanding of a significant change based on the documentation provided by the applicant;

    (b) conducts an assessment of safety and quality management processes in designing and implementing the significant change, if these processes are no longer certified by the competent body assessing conformity;

    (c) conducts an assessment of how the processes of safety and quality management in designing and implementing the significant change are applied.

    Regulation 402 adds “internal or external person, organization or entity” to the definition.

    Regulation 352/2009 has been in force since 1 July 2012. However, this Regulation has applied since 19 July 2010:

    (a) to all significant technical changes in the vehicles, which are defined in Art. 2 of Directive 2008/57/EC;

    (b) to all significant changes in structural subsystems, when required by Art. 15 paragraph.1 Directive 2008/57/EC or TSI.

    Regulation 402/2013 has been applied since 21 May 2015.
