Privacy under siege? A critical analysis of the tele-traffic monitoring system in Tanzania

This article analyses laws on electronic communication content and traffic data in Tanzania in the context of the constitutional right to privacy. The analysis has been motivated by the recent acquisition of Telecommunication Traffic Monitoring System (TTMS) by the government and public fears about potential violations of their right to privacy. The argument that is put forward in this article is that the Electronic and Postal Communication (Tele-Traffic) Regulations 2018 as well as other legislation that is applicable do not provide sufficient safeguards for protection of the right to privacy and thus create potential risks for privacy violation.

Der Beitrag analysiert die Gesetzgebung Tansanias zu elektronischen Kommunikations- und Verkehrsdaten vor dem Hintergrund des in der Verfassung verankerten Rechts auf Privatheit. Anlass sind der kürzlich erfolgte Erwerb des Telekommunikationsverkehrsüberwachungssystems TTMS durch die tansanische Regierung und die damit einhergehende Sorge um mögliche Verletzungen der Privatsphäre. Nach Ansicht des Verfassers bieten die 2018 erlassenen Electronic and Postal Communication (Tele-Traffic) Regulations 2018 wie auch andere einschlägige Gesetze keine ausreichenden Sicherheiten zum Schutz der Privatsphäre.
