Study on Social Organization Standard Copyright in China

ABSTRACT

At present, the social organization standards are developing rapidly in China. But the awareness of intellectual property protection of many social organizations is still very weak. Facing the severe situation of intellectual property protection at home and abroad, it is necessary for social organizations to formulate their copyright policies of social organization standard to protect the copyright of their standards and help them to reduce the infringement of other organization's copyright. Based on Chinese 'Copyright Law', this paper analyzes the copyright of our social organization standards, and points out that the social organization standards own copyright. The copyright of the social organization standard belongs to the social organizations, and anybody that wants to use the social organization standard should get the copyright license. According to the practice of International Standard Organization Copyright disposal, it points out that our social organizations should institutionalize their copyright of social organization standards, make clear the copyright declaration on the standard text. In the copyright policy of social organization standards it should explicit the scope of the social organization standard, the drafters' rights and obligations, and deal with the personal right and property right of social organization standard copyright individually.
